What is the Difference Between a Design and Patent?

While design registration in Pakistan focuses on the visual aspects of a product, patent registration provides broader protection for new and inventive technical solutions, including both functional and ornamental elements. Depending on the nature of the innovation, a business or individual may choose to pursue design or patent protection, or in some cases, both.

The main differences between design and patents lie in the following characteristics:

Nature of protection:

Design registration protects the visual design or aesthetic aspects of an article, such as its shape, configuration, ornamentation, or pattern. Patent registration protects new, inventive, and industrially applicable inventions, covering products, processes, and improvements.

Scope of protection:

Design registration focuses on the appearance and ornamental features of a product but does not protect the functional aspects. Patent registration provides broader protection, covering the functional and technical aspects of an invention.

Duration of protection:

Design registration lasts for 10 years from the filing date, with the possibility of extension, whereas patent registration lasts for 20 years from the filing date, providing a more extended period of exclusivity.

Subject matter:

Design includes the visual or aesthetic aspects of industrial products while patents include new products, machines, processes, and technical innovations.

Requirements for protection:

The design should have novelty and originality in its visual appearance, while the patent requires novelty, inventive steps, and industrial applicability for the invention.

Design registration protects against unauthorized copying or imitation of the visual design. Patent registration protects against the unauthorized making, using, selling, or importing of the patented invention.

What is Patent Registration in Pakistan?

Until October 2000, the registration and protection of patents and designs in Pakistan were governed by the Pakistan Patents and Designs Act, of 1911. In alignment with the GATT/TRIPS agreements, this act was replaced by the Patents Ordinance, 2000, on October 26, 2000. The Patents Ordinance, of 2000, specifically addresses the registration and protection of patents. To facilitate the implementation of the Patents Ordinance, the Patents Rules, 2003, were introduced on December 31, 2003. These rules outline the procedures and regulations necessary for the effective functioning of the Patents Ordinance.

Procedure for Registering a Patent in Pakistan

Conducting a Patent Search

Before applying for a patent, it’s recommended to conduct a patent search using Form P-27 and the required fee. This search helps identify conflicting patents and assesses the novelty of the invention compared to existing art. Based on the findings, a patentability report is compiled to evaluate the invention’s eligibility. Conducting a patent search is crucial before submitting a patent application.

Preparing the Patent Documents

The second step is preparing a patent specification, which should begin with the title of the invention and be signed as well as dated by the application or the patent attorney/patent agent.

Filing a Patent Application

An individual can work on two types of applications under the patent law to register a patent.

  • Ordinary Application: filed as per the patent law for patent registration in Pakistan.
  • Convention Application: made within twelve months after the date of an ordinary application. Submitting a Convention application offers the advantage of having the right of priority dated from the official date of the initial patent application made in the Convention country. This ensures a clear and recognized timeline for priority rights in the patent application process.

Examination of the Patent Application

  • The IPO will examine the application for formal and technical compliance.
  • If any deficiencies are found, an Examination Report will be issued to the applicant for addressing them within a specified time.
  • After addressing any deficiencies and fulfilling all requirements, the application will be accepted.

Acceptance, Publication, and Opposition of the Patent Application

  • The accepted application will be published in the IPO’s official journal.
  • Anyone can oppose the grant of the patent within three months of publication.
  • If there are no oppositions or they are successfully resolved, the patent will be granted.

Grant and Sealing of a Patent

  • The applicant will receive a patent certificate, and the invention will be protected for a period of 20 years from the filing date.
  • Annual renewal fees must be paid to maintain the patent in force.

Renewal of Patents in Pakistan

According to the Patents Ordinance 2000, the term for a registered patent has been extended from 16 to 20 years. The individual can pay the renewal fee in the fifth year from the date of filing the patent. A grace period of six months is allowed with a penalty. 

The Patents (Amendment) Ordinance 2006 allows due annuities and renewal fees to be paid even if the application has been accepted and sealed after the due date.

The filing fee for a Patent Application is PKR 6,750. An additional fee of PKR 90 per page is applicable for the specification beyond 40 pages. What is the term for registered designs in Pakistan?

The term for a registered design is 10 years from the registration date. However, it can be extended to the second and third periods too, making it a total of 30 years. 

How can one get a certified copy of an accepted Patent application?

To obtain a certified copy of an accepted patent specification, applicants are required to submit a request to IPO-Pakistan using Form P-26 formally. The request must be accompanied by the prescribed fee of PKR 2,250, payable through a Cheque made out in the name of the Director General of IPO-Pakistan.

Is there any online database for searching patents in Pakistan?

There is no online database for the Patent Office of Pakistan. However, you can put in a patent database search request on form P-27 for an amount of 1,500 PKR and submit in the form of a cheque made out to the Director General IPO Pakistan at the Patent Office, 2nd Floor Kandawala Building, Main M.A Jinnah Road, Karachi.
